Federal Election Commission Attn: Michael Williamson, Campaign Finance Analyst 1050 First Street NE Washington, DC 20463 Response to RFAI Dated April 8, 2024 REFERENCE: AMENDED YEAR-END REPORT (07/01/2023 - 12/31/2023), RECEIVED 03/21/2024 Dear Mr. Williamson, In response to your Request for Additional Information (RFAI) dated April 8, 2024, the Coalition for Fantasy Sports PAC (“Committee”) provides the following information. 1. The Committee’s March 21, 2024, amended report reflects an increase in receipts totaling $112,500 and disbursements totaling $26,400 from the amounts disclosed in the original report for two reasons. First, the compliance officers did not have access to view the committee’s bank accounts. Second, the Committee did not initially establish internal controls for monetary inflows, miscellaneous increases, or non-federal disbursements. Upon discovery, the missed transactions were immediately filed. Moreover, since discovering these transactions, the Committee devised and implemented internal procedures to monitor and review inflows and miscellaneous increases, and to pre-clear disbursements. Further, the Committee has retained a reliable compliance firm and given them permission to view the Committee’s bank accounts to ensure the correct filing of these reports going forward. The Committee and its officers did not intend to conceal or mislead the Federal Election Commission or the public regarding their activities. 2. The Committee maintains a non-contribution account consistent with Carey v. FEC. The contributions from Fantasy Sports Operator Coalition (8/7/2023 $100), PrizePicks (10/27/2023 $55,125), and Blitz Studios, Inc. (10/30/2023 $55,125) were deposited into the Non-Contribution account. As directed by the RFAI, the Committee updated the disclosure of these three contributions as follows: a. On April 25, 2024, the Committee amended the 2023 year-end report. The disclosure of the 8/7/2023 $100 contribution from Fantasy Sports Operator Coalition to the Committee now reflects that the contribution was deposited to the non-contribution account, and the memo text states, “Non-Contribution Account.” b. On April 25, 2024, the Committee amended the 2023 year-end report. The disclosure of the 10/27/2023 $55,125 contribution from PrizePicks to the Committee now reflects that the contribution was deposited into the non-contribution account, and the memo text states, “Non-Contribution Account.” c. On April 25, 2024, the Committee amended the 2023 year-end report. The disclosure of the 10/30/2023 $55,125 contribution from Blitz Studios, Inc. to the Committee now reflects that the contribution was deposited into the non-contribution account, and the memo text states, “Non-Contribution Account.” Thank you for bringing this issue to our attention.
